Chapter 2: Constitutional rights theory
Restricted access

This chapter and Chapter 6 are closely interlinked. Chapter 2 presents the theoretical framework on which this book is based, introducing Robert Alexy’s theory of constitutional rights norms. In doing so, it clarifies the terminology essential for the analysis and the concept of principles which will be applicable here. This chapter lays the groundwork for the norm analysis in the book, as it introduces the tool which will then be used to evaluate the constitutional norm character of EU citizenship norms in Chapter 6.
