The analysis in Chapter 3 facilitates the application of Alexy’s German law-based constitutional rights norm theory to the EU legal framework. The chapter discusses the constitutional characteristics of the EU legal order, its historic context and different approaches to constitutional analysis in the EU context. In doing so, it shows how the discourse of principles as specific norm categories is relevant in the wider debate of constitutionalism in the EU.
