Chapter 2 examines the legal scope of EU development cooperation policy, first, by assessing the scope of the competence as defined in primary and secondary law and, second, by analysing in detail the case law. This analysis covers an assessment of the evolution in the objectives of EU development cooperation policy as reflected in the Treaty, in secondary legislation, in soft law, and in international agreements. It also covers an in-depth assessment of the evolving case law of the Court of Justice on the choice of the correct legal basis and its application to the scope of EU development cooperation.
