Chapter 10: Human rights in the origins of the FCTC

There is a common misconception that human rights considerations were a fundamental underpinning of the WHO’s FCTC when it was negotiated in the 1990s. In reality, there was little explicit consideration of human rights commitments in the negotiation phase, and a human rights framework was not integrated in the final text of the FCTC. This chapter looks at the origins of the FCTC – its development, its purpose, and why human rights considerations were absent in the design of the Convention.
