In this chapter, I explain how to foster cooperation between blockchain and antitrust from a practical perspective. I first elaborate a positive agenda that would lead authorities to create comfort zones (safe harbors and legal sandboxes), enabling blockchain developers and communities to experiment on modifications that eliminate most anticompetitive behavior while protecting blockchain’s key functions (Section 1). I also explain how to shift enforcement toward specific practices. These two propositions would ensure that blockchain communities implement the “law is code” approach, ultimately guaranteeing the proper application of the rule of law. I then discuss how blockchains could help decentralize regulators (Section 2). I show that “futarchic” governance could eventually lead to merging law and technology. That is a distant dream, but not an impossible one.
