This chapter analyses the Russian legislation on the requirements for voluntary informed consent. It considers the necessary content of the information to be disclosed to the patient before medical treatment. It further considers the legal status of the recipient of the information and the nature of the responsibilities of the information provider; and explains when medical care can legally be provided without informed consent. Judicial practice in relation to violations of the rules on the documentation of informed consent –particularly failures to disclose risks prior to medical intervention – is also considered; in doing so, the legal gaps and challenges of applying the legislation framework on informed consent are identified.
