Unless parties have agreed a choice of forum clause or the matter is subject to exclusive jurisdiction under Article 24 of Brussels Ibis, they shall sue in a member state within the territory of which the residence of the defendant is situated. If the conditions laid down in Articles 7 to 9 of Brussels Ibis are met, the claimant has the option of bringing action for injunctive relief in a member state other than the member state in whose territory the residence or the seat of the defendant is situated. In this chapter the international jurisdiction rules for injunction actions under Article 4 and Article 7(1) and (2) Brussels Ibis, with particular reference to injunctions for the protection of personality rights, intellectual property rights, fairness of commercial transactions and consumer rights are examined.
