Chapter 10: The Québec Mandatory OHS ‘Prevention Programme’

INTRODUCTION This chapter examines the implementation by the Québec inspectorate of the process requirements of the ‘Prevention Programme’ under Québec’s Act Respecting Occupational Health and Safety (AOHS) of 1979. This kind of requirement is not found in the majority of North American jurisdictions. In the US, employers’ opposition stopped OSHA’s proposal for a safety and health programme rule in 1998 (LaTourette and Mendeloff 2008, iii); at present only 12 states have such a programme.1 In Canada, a written OHS programme is mandatory in all workplaces in three out of 11 jurisdictions (in some jurisdictions only in firms with a threshold number of five or 20 workers), and in specific sectors or workplaces in three further jurisdictions, including Québec (Simard 2000 updated). In fact, the Québec reform process was stopped half way: only 15 out of 30 economic sectors are covered by the Prevention Programme provision. Thus, in building on themes already established in the book, this chapter will focus on three questions: + + How did the Prevention Programme requirement fit within the broader ambit of inspectorate activity? How did changes in work organization, the labour market and the broader political economy in Québec impact on the OHS regime and inspectorate activity?
