Chapter 8: The proposed reform of EU rules on public procurement: a postal sector perspective
This chapter aims to review the implications for the postal sector of the ongoing review of the EU rules on public procurement. On 20 December 2011 the European Commission (‘the Commission’) published its proposals for two new directives on public procurement, one to replace Directive 2004/18/EC (the ‘Classic Directive’) and one to replace Directive 2004/17/EC (the ‘Utilities Directive’), with the stated aims of ‘simplification’ and ‘flexibilisation’. The revision of the public procurement directives is part of an overall program to thoroughly modernize public tendering in the EU, which also includes a directive on concessions. The proposed public procurement package, which is under examination with the Council and the European Parliament, aims to modernize public procurement rules by increasing the efficiency of public spending and reducing transaction costs for public authorities and private enterprises. This would be done on the one hand by making the public procurement rules more flexible and simple, and on the other by allowing better use of public procurement in support of common societal goals.
