Chapter 8: International arbitration and energy: How energy disputes shaped international investment dispute resolution
An'bal Sabater and Mark Stadnyk
Extract
International energy disputes have developed their own techniques and solutions - and have also influenced the way other disputes are resolved. Investment awards in oil and gas disputes, for instance, have helped create types of arbitration and substantive protections that have eventually spread across all industries. This chapter will specifically trace the genesis and evolution of several concepts at the heart of the modern investment protection regime - a regime in which the investor, regardless of economic sector, has significant procedural and substantive rights it did not enjoy several decades ago - and show how they are indebted to energy disputes.
