Representations may be made by one party to the other regarding the future conduct of a project either at the start of the relationship or during a ‘rescue’ stage. This chapter considers the particular difficulties with recovering losses caused by misrepresentation during an attempt to rescue a project, particularly the issue of demonstrating reliance on such a representation. The well-known litigation between BSkyB and EDS/Hewlett-Packard is used in his chapter to illustrate how such disputes can play out in practice.
