Chapter 15 examines the various methods which might be used to resolve a dispute arising during the course of a project. The drafting and enforceability of contractual escalation clauses, sometimes called tiered or stepped dispute resolution procedures, are discussed in the context of Cable & Wireless v IBM, as are the pros and cons of agreeing or appointing standing and ad hoc dispute boards. Reference is made to the rules of various institutions, including the ICC, the AAA, the Chartered Institute of Arbitrators, and the Dispute Resolution Board Foundation.
