Disclosure is a complex and expensive stage in the litigation process, particularly so in technology disputes. This chapter provides advice on all aspects of disclosure under CPR 31 to assist those involved in the exercise, from the early stages of document preservation, through electronic disclosure, to common practical issues with inspection. It includes tips on how to identify custodians, how to handle the types of document commonly encountered, where to look for the documents involved in typical technology projects, how to ensure that relevant material is properly preserved and reviewed, and how to prepare electronic disclosure questionnaires for the court.
