Abstract
This chapter considers what is meant by ‘image rights’ in a European context and looks at the different types of image rights protection whether based on privacy, data protection, intellectual property law or dedicated statute. It also provides some practical guidance on how businesses can minimise the likelihood of an image rights claim both in terms of recordings which take place in a public place and the contractual protection which is required with celebrities and models.
